Car Park Terms and Conditions
Please read these Terms and Conditions carefully. They relate to your use of our car parks.
By entering or using a Browntree Properties Ltd car park you agree to comply with these Terms and Conditions.
1. Definitions
When the following words are used in these Terms and Conditions (the “Terms”), this is what they will mean:
1.1 “we”, “us”, and “our” means Browntree Properties Ltd, Company Registration No. 04412792, whose registered office is at:

1.2 “CCTV” means closed-circuit television cameras used for security and operational monitoring within the Car Park.
1.3 “Car Park” means the parking facilities located on land owned, leased or managed by Browntree Properties Ltd and designated for vehicle parking.
1.4 “Parking Charge” means a charge issued where a vehicle has breached these Terms and Conditions.
1.5 “Vehicle(s)” means any motor vehicle used to convey passengers or goods, including cars, vans, motorcycles or any mechanically powered vehicle entering the Car Park.
1.6 “VRM” means Vehicle Registration Mark (vehicle number plate).
2. Our Liability to You
2.1 We will operate the Car Park with reasonable skill and care. If we fail to do so, we are responsible only for direct loss or damage suffered as a foreseeable result of our negligence.
2.2 Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence or that of our employees or agents.
2.3 We do not guarantee that a parking space will always be available. A pre-booking provides parking during the booked period but does not guarantee a specific parking space unless expressly stated.
2.4 The Car Park may be accessible to members of the public. Vehicles and their contents are parked entirely at the owner’s risk.
2.5 Browntree Properties Ltd shall not be liable for indirect or consequential losses including, but not limited to:
loss of profit
loss of earnings
loss of revenue
loss of data
loss of enjoyment.
3. Parking Tariffs
Parking tariffs are displayed on signage within the Car Park and on our website:

All users must pay the applicable parking tariff and follow the instructions displayed within the Car Park.
Failure to comply may result in the issue of a Parking Charge Notice.
4. Claims and Complaints
If your vehicle sustains damage while in the Car Park, or if it is stolen, or property is stolen from the vehicle, you should:
a) Notify Browntree Properties Ltd as soon as reasonably possible.
b) Report any theft immediately to the police.
c) Notify your insurance company.

Before submitting a claim please refer to Section 2 regarding the extent of our liability.
5. Parking Enforcement
By entering the Car Park you agree to comply with the following conditions.
5.1 Parking Rules
You must:
a) Comply with all signs and markings within the Car Park.
b) Park fully within the limits of a marked bay.
c) Not obstruct roadways, entrances, exits or other vehicles.
d) Only park in areas designated for your vehicle type.
e) Display a valid permit where required.
f) Pay the applicable parking tariff.
g) Comply with the terms of any pre-booked parking session.
5.2 Breach of Terms
Failure to comply with these Terms and Conditions may result in the issue of a Parking Charge Notice and recovery of the charge together with reasonable administrative costs.
5.3 Vehicle Monitoring
The Car Park may be monitored by CCTV systems for the purposes of:
safety and security
crime prevention
monitoring parking activity
enforcing these Terms and Conditions.
Where enforcement action is necessary, Browntree Properties Ltd may request vehicle keeper details from the Driver and Vehicle Licensing Agency (DVLA) in accordance with applicable regulations.
6. Security of Your Vehicle
6.1 You must ensure your vehicle is securely locked and all windows are closed before leaving it.
6.2 CCTV may be installed within the Car Park for security and operational purposes, however this does not guarantee vehicle security.
7. Possessions
Any possessions left inside a vehicle remain the responsibility of the vehicle owner.
Browntree Properties Ltd accepts no liability for theft or loss of property from vehicles.
Employees or agents are not authorised to accept personal belongings for safekeeping.
8. Safety in the Car Park
For safety reasons you must:
drive carefully within the Car Park
obey speed limits and directional signs
supervise children and animals at all times
remain aware of moving vehicles.
9. Parking and Payment
Parking at Browntree Properties car parks operates through online booking and payment.
Users must ensure that:
a valid parking booking has been made online
the correct Vehicle Registration Mark (VRM) is entered during booking
payment has been successfully completed
the vehicle leaves the Car Park within the booked parking period.
Vehicles that remain longer than the booked period may incur additional charges.

10. Access and Relocation of Vehicles
Browntree Properties Ltd reserves the right to:
refuse admission to any vehicle
move vehicles within the Car Park where necessary for safety or operational purposes
remove vehicles where the Car Park must be temporarily or permanently closed.
Reasonable care will be taken when relocating vehicles.
11. Abandoned Vehicles
Any vehicle left in the Car Park for more than 28 days without notification may be considered abandoned.
Browntree Properties Ltd reserves the right to remove and dispose of abandoned vehicles in accordance with applicable law.
Where possible the registered keeper will be contacted before disposal.
12. Prohibited Activities
The following activities are not permitted within the Car Park:
vehicle repairs or servicing
commercial activity
littering or dumping waste
dangerous or reckless driving
excessive noise or disturbance
overnight stays or camping
illegal activity
obstructing entrances, exits or access routes.
Browntree Properties Ltd reserves the right to require any person breaching these rules to leave the premises.
13. Force Majeure
Browntree Properties Ltd shall not be liable for loss or damage caused by circumstances beyond our reasonable control including:
severe weather
natural disasters
civil unrest
terrorism
transport disruption
technical failures.
14. Variation of Terms
These Terms and Conditions may only be amended in writing by Browntree Properties Ltd.
No employee or agent is authorised to alter these Terms.
15. General
Each provision of these Terms operates independently. If any provision is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
